Book excerpt: This research focuses on the intersection between international intellectual property law, climate change and energy policies. The aim of this work is to balance intellectual property rights with environmental rights. TRIPS, UNFCCC and WIPO's 2007 Development Agenda comprise the international rules regarding intellectual property and climate change. This work discusses all of these mechanisms but concentrates on TRIPS. This thesis investigates corresponding TRIPS terms and whether the Agreement facilitates or impedes clean energy technology transfer into the developing countries. Additionally, it suggests alternative solutions in removing the barriers to technology transfer.
