Book excerpt: "The purpose of this report is to outline the legal standards for drainage of surface waters in Kentucky in order to assist engineers in developing an understanding of their application. Engineers designing highway drainage structures should be aware of legal guidelines the Department should observe and respect in its handling of surface waters incident to highway facilities. This objective may be accomplished by first stating the legal standards or doctrines which the courts in Kentucky have employed and which the Department of Highways should recognize. Specific cases in which the Department was involved in litigation have been examined to see why the Department was liable for damage. It is hoped that by illustrating the different elements of the legal standards with the actual engineering plans or a discussion of the actual field conditions over which the controversy arose, Department engineers may, thereby, avoid legal redress in the future by employing due foresight in designing the facility."--Page 29.
